Canada Tightens Rules on Intra-Company Transferee Work Permits Under New Regulations

Canadian immigration authorities have implemented new restrictions on Intra-Company Transferee (ICT) work permits, effective October 3. The changes are part of a broader effort to ensure that these permits are used strictly for their intended purpose: to facilitate the temporary transfer of executive personnel from multinational corporations (MNCs) expanding their operations in Canada.

Intra-Company Transferees are foreign workers who are transferred from an overseas branch, subsidiary, or affiliate of an MNC to its Canadian office. 

These transfers, which typically involve executives, managers, or specialized knowledge workers, are exempt from requiring a Labor Market Impact Assessment (LMIA) under the International Mobility Program (IMP). 

The new regulations, however, significantly tighten the conditions for the issuance of such work permits.

Employers must now demonstrate a stronger connection between the foreign and Canadian entities and prove the transfer aligns with the ICT program’s original intent. 

The new rules aim to limit the influx of foreign workers under these provisions, following a surge in applications in recent years, particularly during the post-COVID-19 period.The move is part of the Canadian government’s broader initiative to manage the number of foreign workers entering the country. While the IMP and LMIA exemptions remain essential for facilitating business expansion and transferring key personnel, the new measures signal a shift toward stricter regulation of work permits under this category.
