Intra-company transfer is a common way used by many international workers to move to Canada. If you are working for an organization that has a branch/subsidiary/affiliate in Canada, you can try for an intra-company transfer to secure a work permit.

If your application is approved under this stream, you can get a temporary work permit. As such for a transferee, the work experience obtained can be leveraged as a springboard to gain permanent residency in Canada. This work experience has a high value under Canada’s points-based immigration system. The family members accompanying you can also join you in Canada, with the spouse or common-law partner on an open work permit.

Your employers who are helping international staff come to Canada as intra-company transferees are not required to obtain a Labor Market Impact Assessment (LMIA). This helps accelerate the process and makes it simpler and affordable. Qualified Intra-company transferred employees are encouraged by the Canadian government to apply as they can deliver considerable economic benefit to Canada. They bring their unique skills and expertise to the Canadian labor market. These transferees can come from any country.

Eligible Categories

To be eligible to work under the intra-company transfer program, you must be in one of these categories:

  • Executives
  • Senior managers
  • Workers with unique skills or knowledge

In all these categories, the employees transferred to Canada must have worked for at least one year as full-time employees. They must come to Canada to do the same or similar work. For a work permit to be issued, the employer and the employee must have a qualifying connection.

Work Permit Duration

The Immigration, Refugees and Citizenship Canada (IRCC) specifies that initial work permits granted under this program are issued for a one-year duration. However, these work permits can be renewed subject to certain conditions:

  • The Canadian and foreign companies continue to have a qualifying relationship
  • The new office in Canada has been continuing in business for the past year
  • There is adequate staff in the new office

Intra-company transferees get a real chance to become permanent residents of Canada. They can reside and work anywhere in Canada.

Intra-company transferees looking to gain a permanent residency in Canada can get Comprehensive Ranking System or CRS points without getting an LMIA. This makes it easy for these transferees to increase their CRS scores. An impressive score can boost their chances of being invited to apply for Canadian permanent residence.

How to Apply 

The Intra Company Transfer Process depends on the nationality of the transferee. A temporary foreign worker from a visa-exempt country can apply for an Intra Company Transfer Work Permit at the port of entry (POE). All others should apply online. They can also request an opinion from the International Mobility Program Unit to know if an LMIA exemption is applicable to their situation. This opinion is valued by the border services authorities and, if considered positively, can speed up the process.

Documents Required for Intra Company Transfer 

  • Completed application for LMIA-exempt work permit
  • Online offer of employment submitted through the website of the employer
  • A business plan
  • Supporting documents for local and foreign companies
  • Proof of current employment for the transferee
  • A letter of invitation from a local organization

Eventually, some applicants/workers who start working in Canada as intra-company transferees are likely to become naturalized Canadian citizens. This is possible only after the Canadian authorities grant permanent residence.
