To visit, work, study, and settle in Canada, you need a permit from the Canadian government, which can pave the way for a smooth entry into the country. Such permissions are approved at the discretion of the Canadian immigration department. Naturally, all applications for permits do not get approved automatically. Some of them get rejected or refused too.

If you are among those unfortunate applicants who have been refused the permit to visit Canada by the Immigration, Refugees, and Citizenship Canada (IRCC), there are options available to reverse the refusal.

Make an Appeal Against the Decision to Refuse

If you are sure your application is complete in all respects and complies with all the terms and conditions mentioned by the IRCC, you can appeal that your application was unfairly rejected or refused. You can request a reconsideration of the refusal decision.

If you are confident that your application has complied with all the conditions required by the IRCC and your permit was unfairly rejected, you can appeal the decision. You can also ask for reconsideration of the decision.

Submit a New Application

If you think the grounds for the rejection of your application were legitimate, you can make a new application. You must make sure that the new application focuses on addressing the reasons for which the previous application was refused. If you feel new documents must be added to the application to boost the chances of approval, you must do that.

Steps You Can Take If Your Application is Refused

When your visa application is refused, you will receive a letter from the visa officer stating the reasons for the refusal. Only basic information will be shared in the letter. You have the right to request the officer for more details. Once you have a detailed note, you can assess if the grounds for refusal were valid or unjust. If the reasons seem valid, you can make a new application that addresses the reasons for refusal.

If you believe the reasons for refusal are invalid, you can appeal for reconsideration.

Your Financial Status May Seem Inadequate

You must demonstrate your financial stability to live and support yourself and your dependents. The inability to do so may force the IRCC to refuse you a visa. The problem can be addressed by submitting additional documents that prove you have the funds needed to meet your immigration needs.

Your Travel Documents May Not Be in Order

IRCC insists on a comprehensive set of documents that can help them establish your identity and other aspects needed for approval of your application. If you don’t have a complete record of all the documents and papers demanded by the IRCC, your application can be refused. IRCC must be able to verify your identity to determine if you are legally and medically admissible to Canada. If your application is rejected, reapply with additional supporting documents and evidence to cover the gaps. Make sure the documents are legible and easy to read and understand.

Other Reasons For Refusal Include:

  • Failure to show a clear intention for residing in Canada
  • Inability to show inadmissibility on the grounds of criminality, security, or human rights violations

Your Options If You Received a Refusal for Permanent Residency

If your application for permanent residency is refused, you can appeal to the Immigration Appeal Division (IAD) or the Federal Court of Canada. However, this appeal must be made within a stipulated time frame. However, this is generally used as a last resort when all the above-mentioned options fail to provide you any relief. It must be noted that the Federal Court of Canada cannot order approval or permanent residency for your case. They will look at the merits of the argument, and if they approve, your case will be returned to the IRCC with an order for reconsideration.

You must follow the stringent guidelines applicable for appeals and reviews.
